Settling Disputes Outside of the Courtroom
In response to the steady rise in legal disputes the Courts in Florida often require all parties to these disputes to undertake mediation before a lawsuit proceeds to trial or arbitration. Pre-suit mediation is also often undertaken by the parties in an effort to reach a settlement prior to embarking on what may be a lengthy, expensive and uncertain trial process.
Mediation is usually voluntary, although participation may be mandated by contract or by the Court. Settlement, however, can never be mandated. When settlement is reached, studies show that mediated agreements are more likely to be complied with than decisions imposed by arbitrators or judges. This success may be due to the fact that the parties take an active role in the decision-making process.

The aim of mediation, a form of alternative dispute resolution (ADR), is to reduce congestion in the state courts of Florida. However, in addition, experience has shown that mediation saves time and money, is less adversarial and therefore less stressful and allows the parties to reach a settlement in an informal, more relaxed and completely confidential setting.
